1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you"), and Kaestria ("Company," "we," "us," or "our"), concerning your access to and use of the RankingRider Wix application (the "App").

By installing or using the App, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must uninstall the App and discontinue use immediately.

2. Company Information

The App is developed and operated by Kaestria.

3. Description of the App

RankingRider is a Wix application that uses AI (Google Gemini API) to generate and optimize product SEO content — including titles, meta descriptions, and keywords — for Wix Stores merchants. The App integrates with the Wix Stores Catalog V3 API to read product data and publish optimized content upon explicit merchant request.

4. Intellectual Property Rights

The App, its source code, design, and all related content are the proprietary property of Kaestria and are protected by intellectual property laws of France and international conventions.

Your Generated Content: You retain ownership of the SEO content (titles, descriptions, keywords) generated via the App from your product data. You represent and warrant that you own or have the necessary rights to the input data you provide.

5. Subscriptions and Payment

Billing: Paid subscriptions are billed monthly in advance through the Wix App Subscription System. Wix, acting as merchant of record, charges your account, issues the invoice, and remits the net revenue to us. Charges appear on your regular Wix invoice alongside any other paid apps. We do not process, see, or store any payment card information. Any taxes applicable in your jurisdiction are collected and remitted by Wix.

Plan limits: The Free Starter plan includes ten (10) total optimizations across the lifetime of the installation (no monthly reset). The Basic Rider and Premium Elite plans include a monthly quota that resets at the start of each calendar month; unused optimizations do not carry over.

Cancellation: You may cancel your subscription at any time from your Wix Dashboard (Subscriptions → RankingRider → Cancel). Cancellation takes effect at the end of the current billing period; you retain access to paid features until then. Upon cancellation, Wix notifies us via webhook and your plan reverts to Free.

Refunds: Refund requests are handled by Wix in accordance with its app marketplace refund policy. For merchants residing in the EU/EEA, you retain your statutory right to withdraw within fourteen (14) days of purchase, provided you have not yet used the paid service (i.e., not generated any optimization on the paid tier). Once you perform an optimization on a paid tier, you acknowledge that you waive your right of withdrawal in accordance with EU consumer law on the supply of digital content not on a tangible medium.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable regulations.
• Attempt to reverse engineer, decompile, or extract the source code of the App.
• Resell, sublicense, or redistribute access to the App without prior written consent.
• Use automated scripts to artificially inflate usage metrics or circumvent plan limits.
• Submit input data that infringes any third-party intellectual property rights.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the AI-generated SEO content will achieve any specific ranking results or business outcomes.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Kaestria or its directors, employees, or agents be liable to you for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or loss of data, arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France. Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of France.

10. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by updating the "Last Updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
